Recovering From Abuse

In the event a conservatorship is necessary, allegations of abuse can be expressed to the probate court. Recovery of lost assets and punitive damages can then be pursued through the probate court, which has the ability to enhance punitive awards for fiduciary abuse against an elder/dependent adult by a caregiver. Criminal charges are investigated by law enforcement and criminal charges may be brought against the abuser.

Although you may not be one of the designated mandatory reporters, taking the initiative to report suspected abuse to the proper authorities can cause the intervention and prevention of further abuse. Telephone numbers for the various agencies which can assist you with the reporting of a suspected case are listed in "Resources."

By reporting suspected abuse, an individual can be saved from further physical harm or possibly death. Reporting can also halt any financial abuse, hopefully before a person has lost the assets which they have worked a lifetime for and with which they depend on to provide for their increasing needs.

As an individual, you can make a difference. Pay close attention to your elderly patient, client, customer, neighbor. Report suspected abuse.
